Payment of dividends, if it is violated, does not affect the size of the tax rate for this type of income. This was explained the Russian Finance Ministry in its letter № 03-04-06/3-225 September 19, 2011. Payment of dividends, as well as its order is determined, officials recalled, the company's charter or the general meeting of shareholders on the calculation and payment of dividends. This is stated in the Federal Law № 208-FZ of Article 42 "On Joint Stock Companies". However, there is an important observation period should not be exceeded by more than 60 days from the date of its decision. Therefore, the Finance Ministry said that the breach of the payment of dividends is a serious tax offenses. That, in turn, could lead a society to administrative punishment.
